These Terms of Service ("Terms") govern your use of gitspine software ("Software") provided by Castle Labs LLC ("we", "us", "our"). By downloading, installing, or using the Software, you agree to these Terms.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for its intended purpose.
A Personal license permits use by a single individual on any number of devices owned or controlled by that individual. Personal licenses may not be used for work performed on behalf of an employer or client.
A Commercial license permits use by employees of a single organization. The license covers unlimited seats within that organization. Commercial licenses are required when the Software is used for work performed on behalf of an employer or in a business context.
Student licenses are provided free of charge to verified students with a valid .edu email address. Student licenses are for personal, educational use only and may not be used for commercial purposes.
You may evaluate the Software free of charge for 14 days. After the trial period, a valid license is required for continued use.

The Software, including all copies, modifications, and derivative works, is the exclusive property of Castle Labs LLC and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or service marks.
License fees are billed through our payment processor, Lemon Squeezy. By purchasing a license, you agree to pay all applicable fees and authorize recurring charges for subscription licenses. You may cancel your subscription at any time through your Lemon Squeezy account.
We may release updates to the Software at our discretion. Personal and Commercial licenses include access to updates released during your active subscription period. Priority support is available to Commercial license holders.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASTLE LABS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Castle Labs LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Software or violation of these Terms.
We may terminate your license immediately if you breach these Terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 3, 6, 7, 8, and 10 survive termination.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
These Terms constitute the entire agreement between you and Castle Labs LLC regarding the Software and supersede all prior agreements and understandings.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email to license holders.
